No Stress Fit is a DBA of Digital Elite Marketing LLC (“Digital Elite Marketing,” “No Stress Fit,” “Company,” “we,” “us,” or “our”).
By accessing this website, creating an account, purchasing a product or service, enrolling in a program, participating in an event, or otherwise using No Stress Fit, you agree to these Terms.

4. YOUR RESPONSIBILITY FOR YOUR HEALTH AND PARTICIPATION
You are responsible for determining whether any exercise, activity, program, nutritional practice, challenge, retreat activity, workshop, or other activity is appropriate for you.
You are responsible for obtaining medical clearance when appropriate.
You agree to stop participating and seek appropriate assistance if you experience symptoms or circumstances that make continued participation unsafe.
You understand that information provided to a general audience cannot account for every person's medical history, physical condition, medications, injuries, limitations, or individual circumstances.
5. ASSUMPTION OF RISK
Physical activity involves inherent risks.
These risks may include, without limitation, muscle soreness, strains, sprains, falls, fractures, cardiovascular events, aggravation of existing injuries or medical conditions, dehydration, illness, accidents, and other injuries.
Retreats, workshops, fitness activities, outdoor activities, travel, and similar programs may involve additional risks arising from transportation, weather, terrain, equipment, facilities, food, other participants, third-party providers, and the activities themselves.
By voluntarily participating, you acknowledge and knowingly assume the ordinary and inherent risks associated with the activities you choose to perform.
You are responsible for exercising reasonable judgment concerning your own capabilities and limitations.
Nothing in these Terms is intended to waive or limit liability that cannot lawfully be waived or limited.
6. NO GUARANTEE OF RESULTS
NO STRESS FIT DOES NOT GUARANTEE RESULTS.
Purchasing a product, membership, course, coaching program, challenge, workshop, retreat, or other service does not purchase or guarantee a particular outcome.
Results depend on numerous factors, including your own effort, participation, consistency, implementation, physical condition, circumstances, habits, decisions, and factors outside the control of No Stress Fit.
Testimonials, examples, case studies, transformations, demonstrations, and statements concerning the experiences of other individuals are illustrative only.
They are not promises or guarantees that you will achieve the same or similar results.
No Stress Fit does not guarantee weight loss, muscle gain, improved fitness, improved health, pain reduction, recovery from an injury or medical procedure, athletic performance, psychological outcomes, financial results, or any other particular result.
You are responsible for what you do with the information and resources provided to you.

No Stress Fit may offer products and services including:

Memberships and subscriptions

If product-specific terms conflict with these Terms, the more specific terms presented for that product or service will control with respect to that purchase.
8. PRICES AND PAYMENT
Prices are displayed at the time of purchase and may change at any time for future purchases.
You agree to provide accurate and authorized payment information.
By submitting payment information, you authorize No Stress Fit and its payment processors to charge the applicable purchase price, taxes, fees, or recurring subscription charges disclosed at checkout.
Changing a price does not retroactively alter a completed one-time purchase.
9. DIGITAL PRODUCTS — FINAL SALE
ALL SALES OF DIGITAL PRODUCTS ARE FINAL AND NON-REFUNDABLE ONCE PURCHASED AND ACCESS HAS BEEN PROVIDED, EXCEPT WHERE A REFUND IS REQUIRED BY APPLICABLE LAW.

Downloads
PDFs
Guides
Worksheets
Templates
Recorded content
Digital challenges
Educational materials
Immediately accessible digital resources
Because access to digital products may be provided immediately after purchase, you acknowledge that you receive the benefit of the product when access is provided.
Failure to download, view, complete, or use a purchased digital product does not create a right to a refund.
10. MONTHLY MEMBERSHIPS AND SUBSCRIPTIONS
Certain No Stress Fit memberships and services are offered as automatically renewing monthly subscriptions.
By purchasing a monthly subscription, you authorize No Stress Fit and its payment processor to automatically charge your selected payment method at the disclosed recurring price each billing period until you cancel.
You may cancel your subscription at any time.
Cancellation prevents future renewal charges.
Unless otherwise required by applicable law, cancellation does not result in a refund or prorated refund for the current billing period.
After cancellation, you may continue accessing the applicable membership or subscription through the end of the billing period for which you have already paid.
Your access will then terminate unless you renew or make another purchase.
You are responsible for canceling before your next renewal date if you do not want to be charged for another billing period.
Any changes to subscription pricing will be communicated as required by applicable law before the changed price applies to future recurring charges.
11. LIVE PROGRAMS, CHALLENGES, COHORTS, WORKSHOPS AND EVENTS
Unless different terms are expressly disclosed for a particular offering, participant-requested cancellations are governed by the following policy:
Cancellation 14 or more days before the scheduled start date:
You are eligible for a full refund of the amount paid to No Stress Fit for the applicable program or event.
Cancellation fewer than 14 days before the scheduled start date but before the program or event begins:
You are eligible for a refund of 50% of the amount paid to No Stress Fit for the applicable program or event.
After the program or event begins:
No refunds will be provided.
Failure to attend, participate, complete the program, watch available content, or use available resources does not create a right to a refund.
These policies apply except where a different refund or cancellation right is required by applicable law.
12. RETREATS
Retreats may have additional terms concerning accommodations, travel, activities, deadlines, deposits, participant conduct, health requirements, and other matters.
Unless otherwise expressly stated, participants are responsible for their own travel arrangements and third-party expenses.
This may include airfare, transportation, lodging not expressly included in the retreat purchase, passports, visas, insurance, meals not expressly included, medical expenses, and personal expenses.
We strongly recommend that participants consider appropriate travel insurance for expenses that could be affected by cancellation, delay, illness, weather, or other unforeseen circumstances.
No Stress Fit is not responsible for reimbursement of independently purchased airfare, hotels, transportation, travel insurance, lost wages, or other third-party expenses merely because a No Stress Fit event is changed or cancelled, except to the extent otherwise required by law.
13. CANCELLATION BY NO STRESS FIT
If No Stress Fit cancels an entire paid program, workshop, retreat, challenge, or event and does not provide the purchased event or a replacement accepted by you, No Stress Fit will refund 100% of the amount you paid directly to No Stress Fit for the cancelled offering, subject to applicable law.
Unless required by law or expressly agreed otherwise, No Stress Fit is not responsible for reimbursing third-party expenses associated with the cancelled event, including airfare, hotels, transportation, travel insurance, lost income, childcare, or other incidental expenses.
14. PHYSICAL PRODUCTS AND MERCHANDISE
Physical products and merchandise may be subject to separate shipping, return, exchange, and refund policies disclosed at the time of purchase.
Digital-product refund rules do not automatically apply to physical merchandise.
Nothing in these Terms limits any rights regarding defective, misrepresented, undelivered, or other goods where applicable law provides additional consumer protections.
15. COMMUNITY PARTICIPATION
No Stress Fit may provide communities, forums, group discussions, comment areas, member platforms, or other interactive features.
Users may be permitted to submit comments, photographs, videos, messages, questions, progress updates, or other content.
You agree not to submit content that:
Violates applicable law
Threatens or harasses another person
Infringes intellectual property or privacy rights
Contains malicious software or harmful code
Impersonates another person
Is fraudulent or deliberately misleading
Promotes unlawful conduct
Contains another person's confidential or private information without authorization
Materially interferes with the community or its operation
No Stress Fit may moderate, restrict, remove, or disable access to community content or accounts when reasonably necessary to enforce these Terms, protect participants, comply with law, or maintain the community.
16. USER-GENERATED CONTENT
You retain ownership of original content you submit to No Stress Fit.
By intentionally posting content in areas designed to be visible to other members, you authorize No Stress Fit to display and technically process that content as reasonably necessary to operate the community or service.
You represent that you have the rights necessary to submit the content you post.
We will not use your photograph, testimonial, transformation, name, likeness, or personal story in public advertising or promotional materials merely because you posted it within a private member community.
Any separate promotional use requiring permission will be subject to the consent or authorization obtained from you as applicable.
17. COMMUNITY PRIVACY
You understand that information shared with other participants may be seen, copied, discussed, or otherwise used by those participants.
Do not post information you do not want other community members to see.
Although No Stress Fit may establish community rules, we cannot guarantee that another participant will maintain the confidentiality of information you voluntarily share with them.
18. ARTIFICIAL INTELLIGENCE TOOLS
No Stress Fit may provide tools, assistants, chatbots, calculators, recommendations, summaries, or other features that use artificial intelligence or automated technology.
AI-generated information may be inaccurate, incomplete, outdated, misunderstood, or inappropriate for your individual circumstances.
AI output is provided for educational and informational purposes and should not be treated as medical diagnosis, medical treatment, professional healthcare advice, or a guarantee of accuracy.
You are responsible for evaluating AI-generated information before relying upon or acting on it.
Do not use an AI feature as a substitute for emergency services or professional medical care.
19. INTELLECTUAL PROPERTY
Unless otherwise stated, No Stress Fit and/or Digital Elite Marketing LLC owns or licenses the website and its original content, including:

Videos
Audio
PDFs
Guides
Worksheets
Graphics
Branding
Written materials
Training materials
Program structures
Challenges
Educational resources
Software and digital tools
Website content
Purchasing a product gives you a limited, personal, non-exclusive, non-transferable license to use the purchased material for your own personal use.
Purchasing access does not transfer ownership or intellectual property rights to you.
Without written permission, you may not:
Copy or reproduce materials for distribution
Share login credentials or paid materials
Upload paid materials to file-sharing services
Sell or sublicense materials
Republish materials
Distribute course recordings
Record or redistribute paid sessions where prohibited
Use materials to create substantially copied competing products
Remove copyright, trademark, or proprietary notices
Scrape or systematically extract protected content
Use protected No Stress Fit materials to train an AI model or dataset without authorization
Unauthorized use may result in termination of access and enforcement of available legal rights.
20. AFFILIATE LINKS AND RECOMMENDATIONS
No Stress Fit may recommend products or services provided by third parties.
Some recommendations may contain affiliate links.
If you purchase through an affiliate link, Digital Elite Marketing LLC may receive a commission or other compensation at no additional cost to you.
An affiliate relationship does not mean that No Stress Fit manufactures, controls, warrants, or assumes responsibility for a third-party product.
You are responsible for reviewing the third party's terms, policies, ingredients, instructions, warranties, risks, and other relevant information before purchasing or using the product or service.
21. THIRD-PARTY SERVICES

Your use of third-party services may be governed by separate agreements between you and those providers.
No Stress Fit is not responsible for the independent acts, omissions, privacy practices, availability, or performance of third-party providers except where liability cannot legally be excluded.
22. ACCOUNT SECURITY
If you create an account, you are responsible for maintaining the confidentiality of your login information.
You may not knowingly allow unauthorized individuals to use your paid account.
Notify us promptly if you believe your account has been compromised.
23. PROHIBITED USE
You may not use No Stress Fit or its services to:
Violate applicable law
Commit fraud
Interfere with website security
Attempt unauthorized access
Introduce malware or malicious code
Harass other users
Circumvent access controls

24. SUSPENSION AND TERMINATION
No Stress Fit may suspend or terminate access when a user materially violates these Terms, abuses another participant, engages in fraud, creates a safety or security risk, infringes intellectual property rights, fails to make required payments, or uses our services unlawfully.
Termination for a user's material violation of these Terms does not automatically create a right to a refund.
Nothing in this section eliminates a refund or other remedy required by applicable law.
25. WEBSITE AVAILABILITY
We do not guarantee that nostressfit.com or any particular digital service will be continuously available, uninterrupted, or error-free.
Temporary interruptions caused by maintenance, technical problems, third-party providers, security issues, updates, or circumstances outside our reasonable control do not automatically create a right to a refund.
26. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NO STRESS FIT PRODUCTS, SERVICES, CONTENT, WEBSITE FEATURES, AI TOOLS, AND EDUCATIONAL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
DIGITAL ELITE MARKETING LLC DISCLAIMS WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Nothing in these Terms excludes a warranty or consumer protection that cannot legally be excluded.
27. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL ELITE MARKETING LLC AND NO STRESS FIT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF OUR PRODUCTS, SERVICES, CONTENT, EVENTS, WEBSITE, OR PROGRAMS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF DIGITAL ELITE MARKETING LLC ARISING FROM A PARTICULAR PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID DIRECTLY TO DIGITAL ELITE MARKETING LLC FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
These limitations do not apply where applicable law prohibits the exclusion or limitation of liability.
28. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Digital Elite Marketing LLC, No Stress Fit, and their owners, employees, contractors, and agents from third-party claims, liabilities, losses, damages, or reasonable expenses arising from your unlawful conduct, your material violation of these Terms, or content you submit that infringes another person's rights.
This provision does not require you to indemnify any party for liability that applicable law prohibits from being shifted to you.

Your use of No Stress Fit is also subject to our Privacy Policy.
The Privacy Policy explains how we collect, use, disclose, and protect personal information.
30. CHANGES TO PRODUCTS AND SERVICES
We may modify, improve, replace, or discontinue website features, content, programs, or services.
For already-purchased products or prepaid services, we will honor applicable contractual and statutory obligations.
We may update future offerings, schedules, instructors, content, features, pricing, or formats as our business develops.
31. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The revised Terms will display an updated “Last Updated” date.
When required by applicable law, we will provide additional notice of material changes.
Changes will not retroactively eliminate rights that have already accrued under applicable law.
32. GOVERNING LAW
These Terms and disputes arising from them are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where applicable law requires otherwise.
33. JURISDICTION AND VENUE
To the extent legally permitted, any legal proceeding arising from or relating to these Terms, No Stress Fit, or services provided by Digital Elite Marketing LLC shall be brought in an appropriate state or federal court located in Clark County, Nevada.
You and Digital Elite Marketing LLC consent to the personal jurisdiction of those courts.
Nothing in this provision prevents a consumer from exercising a right to bring a proceeding in another jurisdiction where applicable law prohibits that right from being waived.
34. NO WAIVER
Failure by Digital Elite Marketing LLC to enforce a provision of these Terms does not constitute a permanent waiver of that provision or any other provision.
35. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate.
The remaining provisions will continue in effect.
36. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any additional terms expressly presented for a specific product, service, program, membership, workshop, retreat, or event, constitute the agreement between you and Digital Elite Marketing LLC concerning the applicable use or purchase.
